Une décision récente du Tribunal de première instance du Brabant wallon va sans doute faire jurisprudence à plus d’un titre. Elle apporte une solution innovante quant aux questions de propriété et de possession des cryptomonnaies.
La jurisprudence belge a admis que la propriété d’une cryptomonnaie peut être prouvée par la détention de sa clé privée cryptographique. En effet, seul le détenteur de cette clé privée est habilité et capable techniquement de transférer ces cryptomonnaies sur la blockchain. Cette détention peut être constatée par huissier et/ou expert informatique.
A partir du 1er mai 2022, les prestataires de services d’échange entre monnaies virtuelles et monnaies légales, les prestataires de services de portefeuille de conservation de clés cryptographiques privées (« wallet providers ») ainsi que les exploitants de distributeurs de billets à partir de cryptomonnaies ‘Automated Teller Machines (ATM’s) installés en Belgique seront en outre soumis à de nouvelles obligations liées notamment à la législation anti-blanchiment et devront s’enregistrer auprès de l’Autorité des services et marchés financiers (FSMA).
En outre, la Commission Economie du Parlement Européen a adopté récemment la proposition de règlement sur les marchés de cryptoactifs (Règlement « MiCA »). Ce règlement fixe un régime applicable aux émetteurs de cryptoactifs (ICO, …) ainsi qu’aux prestataires de services sur cryptoactifs.
