Une loi du 20 mars 2023 a modifié l’article 11quater de la loi du 3 juillet 1978 relative aux contrats de travail en vue de limiter la durée de la succession des contrats de travail à durée déterminée et contrats de remplacement (M.B., 28 avril 2023, 43003).

Elle comble la lacune de la loi qui ne prévoyait pas de règles en cas de succession de contrats de travail à durée déterminée avec des contrats de remplacement.

La Cour constitutionnelle avait décidé, dans un arrêt n° 93/2021 du 17 juin 2021, que cette lacune était contraire à la Constitution.

La loi nouvelle limite à deux ans la succession et combinaison de contrats de travail à durée déterminée et de contrats de remplacement.

Cette limite n’est pas applicable lorsque l’interruption est attribuable au travailleur.

En cas de dépassement de cette durée, ce sont les règles relatives aux contrats de travail à durée indéterminée qui seront applicables.

La loi prévoit également une règle particulière.

Lorsqu’un contrat de remplacement succède à plusieurs contrats de travail à durée déterminée ou pour un travail nettement défini, ce contrat de remplacement n’est pas pris en compte une seule fois pour le calcul de la durée totale des deux ans lorsque la succession des contrats de travail à durée déterminée ou pour un travail nettement défini est justifiée par la nature du travail ou par un autre motif légitime.

Dans ce cas, la durée totale de la succession des contrats ne peut cependant pas dépasser trois ans.

Ces nouvelles dispositions sont entrées en vigueur le 8 mai 2023.

Elles s’appliquent aux contrats de travail conclus à partir de cette date.

Cependant, pour le calcul des deux ans, il faut tenir compte des contrats de travail conclus avant le 8 mai 2023 qui précèdent successivement le contrat de travail conclu à partir de cette date.
