LA LOI QUI CHANGE

Depuis le 19 mai 2022, un arrêté royal du 24 avril 2022 a modifié l’article 39 de l’arrêté royal du 30 mars 1967 déterminant les modalités générales d’exécution des lois relatives aux vacances annuelles des travailleurs salariés. Désormais, pour les employés dont la rémunération n’est que partiellement variable, seule une convention collective de travail sectorielle peut permettre de déroger aux dispositions de l’article 39 relatives au mode de calcul du pécule de vacances pour la partie variable de la rémunération. Antérieurement, pareille dérogation était possible par une convention collective de travail conclue au niveau de l’entreprise.

 

LA JURISPRUDENCE SOCIALE LUE POUR VOUS

Dans un arrêt du 25 janvier 2022 (R.G. n° 2019/AB/657), la Cour du travail de Bruxelles a été saisie de demandes en paiement de l’indemnité de protection en raison de la maternité prévue à l’article 40 de la loi du 16 mars 1971 et en paiement de l’indemnité de protection en raison d’une discrimination en application de la loi du 10 mai 2007.

 

Elle a estimé que les motifs de licenciement liés aux nécessités économiques vantés par la société n’étaient pas établis et ne justifiaient donc pas le licenciement de sorte que l’indemnité de protection de la maternité était due.

 

La Cour a également estimé que les faits permettaient de présumer que le motif du licenciement était la grossesse puisqu’un entretien avec l’employeur avait eu lieu dès la communication de l’attestation médicale de grossesse et que cet entretien avait précédé le licenciement de cinq jours. La travailleuse pourrait donc demander l’indemnité de protection pour discrimination.

 

Cependant, la Cour a confirmé sa jurisprudence selon laquelle le cumul entre les indemnités de maternité et de discrimination n’est possible que s’il y a un préjudice distinct. Elle a considéré que le cumul n’était pas possible puisque le dommage exposé (stress d’une part et sentiment d’injustice de l’autre) est couvert par l’indemnité de maternité sur pied de l’article 40 de la loi du 16 mars 1971, dont l’objet est de protéger les femmes enceintes contre les conséquences dommageables d’un licenciement pour leur santé physique et psychique.
