LA LOI QUI CHANGE

La loi du 30 octobre 2022 portant des dispositions diverses relatives à l’incapacité de travail (M.B., 18/11/2022, 82907) prévoit que le travailleur peut ne pas produire un certificat médical pour le premier jour d’une incapacité de travail, ce trois fois par année calendrier. Les entreprises qui occupent moins de 50 travailleurs peuvent déroger à cette règle par CTT ou par règlement de travail.

 

Cette loi modifie également la procédure de force majeure médicale permettant de mettre fin au contrat de travail. Cette procédure ne peut être entamée que pour un travailleur qui est en incapacité de travail ininterrompue d’au moins neuf mois et qui ne fait pas l’objet d’un trajet de réintégration.

 

Après respect par le conseiller en prévention-médecin du travail de la procédure prévue par le Code du bien-être au travail, il peut être mis fin au contrat lorsque le travailleur n’a pas demandé d’examiner les possibilités relatives à un travail adapté ou à un autre travail, lorsque l’employeur ne peut pas proposer un travail adapté ou un autre travail car c’est techniquement ou objectivement impossible ou ne peut être exigé pour des motifs dûment justifiés, ou lorsque le travailleur refuse le travail adapté ou l’autre travail proposé par l’employeur.

 

LA JURISPRUDENCE SOCIALE LUE POUR VOUS

Dans un jugement du 27 janvier 2022 (R.G. n° 18/3.571/A), le Tribunal du travail de Liège (division Liège) a rappelé le caractère impératif de l’article 18 de la loi relative aux contrats de travail, qui limite la responsabilité du travailleur au cas de dol, faute lourde ou faute légère habituelle, de sorte que le travailleur ne peut y renoncer avant la fin du contrat.

 

Sur base d’une « car policy » qui mettait à charge du travailleur une partie des coûts de réparations liés à un accident de la route, l’employeur avait fait signer une reconnaissance de dette pour les dégâts occasionnés au véhicule par laquelle l’employé s’estimait responsable du paiement des réparations. Le Tribunal a estimé que les retenues faites par l’employeur sur base de ce document non valable devaient être remboursées dès lors qu’il ne ressortait pas des éléments du dossier qu’il y ait eu une faute lourde ou un dol et que l’existence d’une faute légère habituelle ne pouvait résulter du fait que l’intéressé aurait eu plusieurs amendes de stationnement puisqu’il n’y a aucun rapport entre l’un et l’autre.
