Un arrêté royal du 23 avril 2023 concernant la prime pouvoir d’achat est entré en vigueur depuis le 1er mai 2023 (M.B., 28 avril 2023, 43033).

Cette prime a été instaurée afin de compenser l’impossibilité d’augmenter la marge salariale et d’augmenter le pouvoir d’achat des travailleurs.

La prime peut être octroyée par les entreprises qui ont réalisé un bénéfice élevé en 2022, pour un montant maximum de 500 euros.

Elle peut être octroyée par les entreprises qui ont réalisé un bénéfice exceptionnellement élevé en 2022 pour un montant maximum de 750 euros.

L’octroi de la prime pouvoir d’achat doit faire l’objet d’une convention collective de travail au niveau sectoriel ou au niveau de l’entreprise.

La convention collective sectorielle doit contenir deux définitions basées respectivement sur les bénéfices élevés en 2022 et sur les bénéfices exceptionnellement élevés en 2022, délimitant les entreprises où de bons résultats ont été obtenus pendant la crise.

Si une telle convention ne peut être conclue en raison de l’absence de délégation syndicale, ou s’il s’agit d’une catégorie de personnel pour laquelle il n’est pas d’usage de prévoir une telle convention, l’octroi peut être régi par une convention individuelle.

La prime doit être octroyée sous la forme d’un chèque consommation papier ou électronique d’une valeur maximale de 500 euros ou 750 euros.

La prime pouvoir d’achat ne peut être émise que du 1er juin 2023 au 31 décembre 2023 inclus.

Les chèques peuvent être dépensés jusqu’au 31 décembre 2024 inclus.

Si la prime est octroyée sous forme de chèque papier, il doit y être clairement mentionné qu’elle est valable jusqu’au 31 décembre 2024 inclus.

5.

La loi du 24 mai 2023 portant des mesures en matière de négociation salariale pour 2023-2024

(M.B., 31 mai 2023) a fixé les règles applicables en matière d’ONSS et de fiscalité.

L’employeur doit payer une cotisation spéciale de 16.5% sur le montant de la prime pouvoir d’achat.

Aucune cotisation personnelle n’est due par le travailleur.

A niveau fiscal, la prime pouvoir d’achat est exonérée d’impôts sur les revenus à concurrence de 750 euros, montant qui n’est pas indexé.

La prime pouvoir d’achat et la cotisation spéciale y afférente constituent des frais professionnels et  ne sont donc pas pris en compte pour l’évolution du coût salarial.
